Terms of service

These Terms of Service govern your access to and use of PHAM’s website, products, and related services (the “Services”). By using the Services or placing an order, you agree to these Terms and our Privacy Policy.

Eligibility and Accounts

You must be legally able to enter into a binding agreement in your jurisdiction. If you create an account, you are responsible for accurate information, confidential credentials, and activity through your account.

Products and Digital Representations

PHAM is an independent fashion label based in Vietnam. We aim to present products accurately. Interactive 3D models, renders, sketches, prototypes, and development imagery may be used as digital garment studies to communicate a design. Material tone, texture, lighting, and production refinements may differ slightly from the final manufactured garment; this does not permit material changes to the essential character of the product.

Limited Editions

Some products are released in limited quantities. Availability is not guaranteed and may end once inventory is allocated or sold out.

Waitlist

Joining a waitlist is not a purchase, does not create a payment obligation, does not begin production or a delivery timeline, and does not reserve inventory unless PHAM expressly states otherwise.

Pre-orders

Where a product is offered for pre-order, the production and dispatch timing shown is an estimate only. It may change due to production, material availability, quality control, logistics, or circumstances outside PHAM’s reasonable control. Mandatory consumer rights remain unaffected.

Orders

An order is an offer to buy. PHAM may accept or decline an order where reasonably necessary, including for availability, payment authorization, suspected fraud, or an obvious error. Acceptance occurs when we confirm the order. Cancellation requests are subject to PHAM’s confirmation and mandatory rights.

Pricing and Payment

Prices and availability may change before an order is accepted. The applicable price is shown at checkout. You must provide accurate payment and contact information and be authorized to use the selected payment method. Taxes, duties, shipping, and import charges are handled as stated at checkout or in the applicable policy.

Shipping

Shipping is governed by our Shipping Policy. Delivery times are estimates, not guarantees. Carrier, customs, and events outside PHAM’s reasonable control may affect delivery.

Returns and Refunds

Returns, exchanges, and refunds are governed by our Refund Policy. Nothing in these Terms limits mandatory consumer rights.

Intellectual Property

The Services and their content, including PHAM names, logos, designs, images, text, and product materials, are owned by PHAM or its licensors and protected by applicable intellectual property laws. You may use the Services only for personal, non-commercial purposes. No licence is granted except as expressly stated in these Terms.

User Content and Feedback

If you submit reviews, feedback, ideas, or other content, you confirm that you have the right to do so and grant PHAM a non-exclusive, worldwide, royalty-free licence to use it to operate, improve, and promote the Services. Do not submit unlawful, infringing, or harmful content.

Third-Party Services and Shopify

The Services may link to or use third-party services. Their terms and privacy practices apply to your use of those services. PHAM’s store is powered by Shopify, but sales are made directly with PHAM; Shopify is not responsible for the sale or fulfilment of PHAM products.

Privacy

Our handling of personal information is described in our Privacy Policy. You may also review our Data Deletion information. Shopify and other providers may process information under their own privacy terms when providing services to you or PHAM.

Prohibited Uses

You must not misuse the Services, interfere with their security or operation, infringe intellectual property rights, submit unlawful or deceptive content, use the Services for unauthorized commercial resale, or attempt to access systems or data without authorization.

Errors, Inaccuracies, and Availability

We may correct genuine errors or omissions relating to product information, pricing, availability, or orders. We will not make material changes to an accepted order without contacting you where reasonably practicable. Services may be unavailable temporarily for maintenance, updates, or matters outside our reasonable control.

Disclaimer of Warranties

To the extent permitted by law, the Services are provided on an “as is” and “as available” basis. PHAM does not exclude any warranty or protection that cannot lawfully be excluded, including mandatory consumer protections.

Limitation of Liability

To the extent permitted by law, PHAM is not liable for indirect, incidental, special, consequential, or punitive losses arising from use of the Services. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability under mandatory consumer law.

Severability and No Waiver

If any provision is held unenforceable, the remaining provisions remain effective. A failure to enforce a right is not a waiver of that right.

Governing Law

These Terms are governed by the laws of Vietnam. This choice does not deprive consumers of mandatory protections available under the laws of their country of residence where those protections apply.

Changes to These Terms

PHAM may update these Terms from time to time. The version posted on this page applies from its publication date. Material changes will be communicated where required by applicable law.
